By using departsdaily.com, you agree to these terms. They exist so everyone knows exactly what this site is — and isn't.
1. WHAT THIS SITE IS
Departs Daily ("we," "us," "the Site") is an independent publisher of travel information: flight deals we've spotted, destination guides, and links to third-party booking services. The Site is supported by advertising and affiliate commissions.
2. WHAT THIS SITE IS NOT
We are not a travel agency, tour operator, airline, hotel, or seller of travel. We do not sell tickets, process payments, hold reservations, or act as anyone's agent. When you click a link and book, your transaction is entirely between you and that third-party provider, under their prices, terms, and policies. Any issue with a booking — changes, cancellations, refunds, service quality — must be resolved with the provider you booked with.
3. PRICES AND AVAILABILITY ARE NOT GUARANTEED
Airfares, hotel rates, and tour prices change constantly, sometimes within minutes. Every fare on the Site reflects what we verified at the date and time stamped on the deal board. Fares may increase, sell out, or disappear at any time after posting. Deal links open a live third-party search so you can see the current price before booking; the price displayed by the booking provider at checkout is the only price that applies. We are not responsible for any difference between a price shown on this Site and the price available when you book.
4. AVERAGES, COMPARISONS, AND DATA SOURCES
Where we describe a fare as "below average" for a domestic route, the comparison baseline is the U.S. Department of Transportation / Bureau of Transportation Statistics Consumer Airfare Report (Table 6): the average fare for that city-pair market across all four quarters of the most recent published year, with DOT's each-way figures doubled to a round-trip equivalent. DOT averages include all cabins (including first class), taxes, and airport fees, and therefore tend to run higher than typical advance-purchase leisure fares — a fare can be well below the DOT average and still be similar to other advance-purchase fares on the route.
DOT does not publish fares for international city-pairs. International route averages, and all month-by-month seasonality patterns shown in charts, are our own estimates derived from public fare tracking. They are labeled as estimates, are provided for general guidance only, and are not price quotes or guarantees. Departs Daily is not affiliated with, endorsed by, or sponsored by the U.S. Department of Transportation or any government agency.
5. AFFILIATE RELATIONSHIPS AND ADVERTISING
Some links on the Site are affiliate links: if you click and then book or buy, we may earn a commission at no additional cost to you. See our Affiliate Disclosure. The Site may also display third-party advertising. Sponsored or commission-earning links do not change our deal selection, which is based on price data.
6. NO WARRANTIES
The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, or non-infringement. Travel information goes stale quickly; verify anything important (prices, schedules, entry requirements, hotel details) directly with the provider before relying on it.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Departs Daily and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of money, savings, bookings, or travel opportunities, arising out of or related to your use of the Site or any third-party site or service linked from it — even if advised of the possibility of such damages. To the extent any liability is found notwithstanding the foregoing, it shall not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. THIRD-PARTY SITES
Links to third-party websites are provided for convenience. We do not control and are not responsible for their content, prices, policies, or practices. Trademarks, airline names, hotel names, and logos are the property of their respective owners and are used for identification only; no affiliation or endorsement is implied.
9. INTELLECTUAL PROPERTY
The Site's original content, design, and branding are owned by Departs Daily. You may share links to the Site freely; you may not scrape, republish, or commercially exploit the Site's content without permission.
10. CHANGES
We may update these terms at any time by posting a revised version with a new effective date. Continued use of the Site after changes means you accept them.
11. GOVERNING LAW
These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules, and any dispute shall be brought in the state or federal courts located in North Carolina.
